1. Description of Service: PowerScale provides an AI-driven platform that generates customized training and nutrition plans for combat sports athletes. All content, plans, and outputs are generated automatically by artificial intelligence algorithms based on user inputs. PowerScale is an independent platform. AI-driven metrics and outputs are powered by third-party artificial intelligence technology.
2. HEALTH AND FITNESS DISCLAIMER (CRITICAL): POWERSCALE IS NOT A MEDICAL ORGANIZATION, AND OUR PLANS DO NOT CONSTITUTE MEDICAL, PROFESSIONAL, OR CERTIFIED COACHING ADVICE. COMBAT SPORTS AND INTENSE PHYSICAL TRAINING INVOLVE INHERENT RISKS OF INJURY. YOU EXPLICITLY AGREE THAT YOU ARE PARTICIPATING IN THESE TRAINING PLANS VOLUNTARILY AND AT YOUR OWN RISK. ALWAYS CONSULT A PHYSICIAN OR A QUALIFIED HEALTHCARE PROVIDER BEFORE STARTING ANY NEW EXERCISE OR NUTRITION PROGRAM. WE ARE NOT LIABLE FOR ANY INJURIES, HEALTH PROBLEMS, OR DAMAGES RESULTING FROM THE USE OF OUR PLANS.
3. User Accounts & Registration: To access certain features, you must register for an account (via our third-party provider, Memberstack). You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Intellectual Property: The platform, its core architecture, design, branding, and original code are the exclusive property of PowerScale. You are granted a limited, non-exclusive, non-transferable license to use the plans for personal, non-commercial use only.
5. Limitation of Liability: "To the maximum extent permitted by law, PowerScale and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the service. The service is provided on an "AS IS" and "AS AVAILABLE" basis.
6. Governing Law: These terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
7. Refund and Cancellation Policy: Due to the digital nature of the services and the fact that training and nutrition plans are generated instantly and customized based on user input, all purchases are final and non-refundable.
